Terms and Conditions

These Terms & Conditions apply to your use of this website and to any order placed through this website. By accessing our website, browsing our products, creating an account, or placing an order, you agree to be bound by these Terms & Conditions. Please read them carefully before using our website or purchasing from us.

Our Guarantee

Every Part Is Unused & Genuine

Car Parts Collective guarantees that every product sold through this website is:

  • Unused — no part has been installed, tested or operated in a vehicle or machinery prior to sale.
  • Genuine — all products are original or OEM-equivalent parts sourced from reputable manufacturers, original factory inventories, authorised distributors or verified suppliers.
  • Not counterfeit — we do not knowingly sell counterfeit, pirated or misrepresented products.

If you receive a product that does not meet this guarantee, please contact us immediately. We will work with you to resolve the matter in accordance with Australian Consumer Law. This guarantee is in addition to, and does not limit, your rights under the Australian Consumer Law.

Throughout these Terms & Conditions, "we", "us" and "our" refer to Car Parts Collective. "You" and "your" refer to the customer, website user or purchaser.

2. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights you may have under the Australian Consumer Law or any other applicable law.

If a product you purchase from us has a major failure, you may be entitled to reject the product and choose a refund, replacement or other remedy available under Australian Consumer Law.

If a product has a minor failure, we may choose to provide a repair, replacement or refund within a reasonable time.

Your rights under the Australian Consumer Law are in addition to any manufacturer warranty, express warranty, store policy, or other promise made by us.

3. Use of Our Website

You agree to use our website for lawful purposes only. You must not use our website in a way that:

  • breaches any applicable law or regulation;
  • interferes with the security or operation of the website;
  • attempts to gain unauthorised access to our systems;
  • copies, scrapes, reproduces or misuses our website content without permission;
  • uploads or transmits harmful code, viruses or malicious material;
  • provides false, misleading or incomplete information.

We may suspend or restrict access to our website if we believe it is being misused.

4. Product Information

We aim to provide accurate product descriptions, images, prices, availability, specifications and fitment information.

However, product images may be for illustration purposes only. Packaging, colour, branding, design, specifications or inclusions may vary depending on the supplier or manufacturer.

You are responsible for checking that a product is suitable for your vehicle, intended use and requirements before placing an order.

Where available, vehicle fitment information is provided as a guide only. If you are unsure whether a product is suitable for your vehicle, please contact us before purchasing.

5. NOS (New Old Stock) Products

Some products listed on our website are classified as "NOS" — New Old Stock. NOS products are genuine, unused parts that were manufactured, packaged and stored some time ago and may never have been sold or fitted to a vehicle.

While all NOS products are unused and genuine, the original packaging may show signs of age, handling or long-term storage. This may include, but is not limited to:

  • damaged, dented, crushed or torn outer packaging;
  • faded, discoloured or sun-affected boxes, cartons or labels;
  • markings, writing, stamps, stickers or annotations applied to the packaging by previous storekeepers, distributors or warehouse handlers;
  • packaging that has been drawn on, written on or labelled with part numbers, pricing or shelf codes;
  • missing, incomplete, loose or partially destroyed packaging — including boxes that are not present at all;
  • packaging that has been opened, resealed or altered;
  • dust, grime, storage marks or other age-related deterioration to the outer packaging.

The condition of the outer packaging is cosmetic only and does not affect the unused, genuine nature of the part inside. Where the condition of packaging is known, it will be noted or shown in the product listing. If you have questions about the condition of a specific product's packaging before purchasing, please contact us.

By purchasing a NOS product from us, you acknowledge that you have read and understood this clause and that you accept the cosmetic condition of the packaging as described in the listing. This does not limit your rights under Australian Consumer Law.

6. Vehicle Fitment

Automotive parts and accessories may be vehicle-specific. You should check all relevant vehicle details before ordering, including but not limited to:

  • make;
  • model;
  • year;
  • series;
  • body type;
  • engine size;
  • fuel type;
  • transmission;
  • VIN, where required;
  • registration details, where relevant;
  • existing part numbers;
  • product measurements and specifications.

If you purchase an item that does not fit because incorrect, incomplete or incompatible vehicle information was provided, this may be treated as a change-of-mind return, unless otherwise required under Australian Consumer Law.

If we have supplied an incorrect item due to our error, or if the item does not match the product description, we will work with you to provide a remedy in accordance with Australian Consumer Law.

7. Orders

When you place an order through our website, you are making an offer to purchase the selected products at the displayed price, plus any applicable shipping costs.

After placing an order, you may receive an order confirmation email. This confirms that we have received your order, but it does not guarantee acceptance of the order.

We reserve the right to accept, reject or cancel an order where:

  • a product is unavailable;
  • there has been a pricing or product description error;
  • payment has not been received or has been reversed;
  • the order appears fraudulent or suspicious;
  • the delivery address is incomplete, incorrect or not serviceable;
  • we are unable to fulfil the order for reasons outside our reasonable control.

If we cancel an order after payment has been received, we will provide a refund for the amount paid for the cancelled item or order.

8. Pricing

All prices are listed in Australian dollars unless otherwise stated. Prices may include GST where applicable.

We may change product prices at any time without notice. Price changes will not affect orders that have already been accepted, except where there has been an obvious pricing error.

If a product has been listed at an incorrect price due to a technical, typographical or supplier error, we may cancel the order and provide a refund.

9. Payment

Payment must be made at the time of purchase using one of the payment methods available at checkout. Available payment methods may include credit card, debit card, PayPal, buy now pay later services, or other payment options shown at checkout.

By placing an order, you confirm that you are authorised to use the payment method provided.

We do not store full payment card details on our website. Payment processing may be handled by third-party payment providers, and their own terms and privacy policies may apply.

10. Buy Now Pay Later Services

If you choose to pay using a buy now pay later provider, your payment arrangement is with that provider. You are responsible for reading and understanding the provider's terms, fees, repayment obligations and eligibility requirements before selecting that payment option.

Refunds for orders paid using buy now pay later services will be processed in accordance with the provider's refund process.

11. Product Availability

Product availability may change without notice. Some products may be supplied directly from our warehouse, a third-party supplier, distributor or manufacturer.

If a product becomes unavailable after you place an order, we may contact you to offer:

  • a suitable alternative product;
  • a backorder, if available;
  • cancellation of the unavailable item;
  • a refund for the unavailable item.

We are not liable for loss or inconvenience caused by stock shortages, supplier delays or discontinued products, except where required by law.

12. Shipping & Delivery

We ship orders in accordance with our Shipping & Delivery Policy. Delivery times are estimates only and may vary depending on your location, product availability, carrier delays, public holidays, weather events, customs processing, supplier delays or other circumstances outside our reasonable control.

Once your order has been dispatched, you will receive tracking details where available.

We are not responsible for delays caused by Australia Post, courier providers, customs authorities or other delivery partners, except where required by Australian Consumer Law.

You are responsible for providing a complete and accurate delivery address. We are not responsible for orders sent to an incorrect address where the address was provided incorrectly by you.

If an order is returned to us due to an incorrect address, refusal of delivery, failure to collect, or unsuccessful delivery attempts, additional postage charges may apply to resend the order.

13. Authority to Leave

Where available, you may be able to request that a parcel be left at your address without a signature. If you provide authority to leave, you accept the risk of loss, theft or damage after the carrier records the parcel as delivered, unless otherwise required by law.

14. International Orders

We may offer international shipping to selected countries. International customers are responsible for any customs duties, taxes, import fees, clearance fees or other charges applied by the destination country.

International delivery times may vary due to customs processing, carrier delays or local delivery conditions.

We are not responsible for delays, charges, seizure or refusal of goods by customs authorities, except where required by law. You are responsible for checking whether the product can legally be imported into your country before placing an order.

15. Risk and Title

Risk in the products passes to you when the products are delivered to your nominated delivery address, unless otherwise required by law.

Ownership of the products passes to you once we have received full payment for the order.

16. Returns

Our returns process is set out in our Returns & Refunds Policy. You may be entitled to a repair, replacement, refund or other remedy under Australian Consumer Law if a product does not meet a consumer guarantee.

We may also accept change-of-mind returns at our discretion, provided the item meets the conditions set out in our Returns & Refunds Policy. Unless otherwise required by law, we may decline a change-of-mind return where the product:

  • has been used, fitted, installed or damaged;
  • is not in original packaging;
  • is missing parts, manuals, accessories or labels;
  • is a special-order item;
  • is a clearance item;
  • is an electrical item that has been opened, installed or used;
  • is a product that cannot be resold for safety, hygiene or compliance reasons.

17. Faulty, Damaged or Incorrect Items

If you receive a faulty, damaged or incorrect item, please contact us as soon as possible with:

  • your order number;
  • a description of the issue;
  • clear photos or videos of the item, packaging and fault, where relevant;
  • vehicle details, if the issue relates to fitment.

We may need to assess the item before confirming the appropriate remedy. Where the product has a major failure under Australian Consumer Law, you may be entitled to choose a refund, replacement or other available remedy. We may decline a claim where the issue was caused by:

  • incorrect installation;
  • misuse, neglect or abuse;
  • normal wear and tear;
  • modification or alteration;
  • use for an unintended purpose;
  • failure to follow manufacturer instructions;
  • incorrect vehicle information supplied by you;
  • damage caused after delivery.

This does not limit any rights you may have under Australian Consumer Law.

18. Manufacturer Warranties

Some products may come with a manufacturer warranty. Manufacturer warranties vary by product, brand and supplier. Warranty periods, conditions and claim processes may differ.

A manufacturer warranty is provided in addition to your rights under Australian Consumer Law and does not replace or limit those rights. Where a manufacturer warranty applies, we may ask you to provide evidence of the fault and may refer the product to the manufacturer or supplier for assessment.

19. Installation

Some products may require professional installation. We recommend that automotive parts and accessories be installed by a qualified mechanic, auto electrician, technician or suitably experienced professional.

Unless we have expressly agreed to provide installation services, we are not responsible for installation costs, labour charges, diagnosis costs, vehicle downtime, towing costs or related expenses, except where required by Australian Consumer Law.

You are responsible for ensuring that any product is installed correctly and safely. Incorrect installation may void manufacturer warranty rights, but it does not remove any rights you may have under Australian Consumer Law where those rights apply.

20. Product Use and Compliance

You are responsible for ensuring that any product purchased from us is suitable, legal and safe for your intended use. Some automotive products may be intended for off-road, motorsport, show, competition or non-road use only.

It is your responsibility to check whether a product complies with applicable road rules, vehicle standards, engineering requirements, insurance requirements and registration requirements in your state or territory before purchase, installation or use.

We are not responsible for fines, defects, failed inspections, roadworthiness issues, registration issues, insurance issues or legal consequences arising from improper, unsafe or unlawful use of a product, except where required by law.

21. Product Reviews and User Content

If you submit a review, comment, photo, video or other content to us, you grant us permission to use, reproduce, edit and publish that content for marketing, website, social media or business purposes. You must not submit content that is false, misleading, offensive, defamatory, unlawful or infringes another person's rights. We may remove or refuse to publish user content at our discretion.

22. Promotions, Discount Codes and Offers

Promotions, discount codes and special offers may be subject to additional terms and conditions. Unless otherwise stated:

  • discount codes cannot be used with other offers;
  • discount codes cannot be applied retrospectively;
  • promotions are available for a limited time only;
  • offers may be changed, suspended or withdrawn without notice;
  • stock may be limited;
  • exclusions may apply.

If there is a conflict between these Terms & Conditions and the specific terms of a promotion, the promotion terms will apply to the extent of the inconsistency.

23. Gift Cards and Store Credit

If we offer gift cards or store credit, additional terms may apply. Gift cards and store credit are not redeemable for cash, unless required by law. Lost, stolen or misused gift cards may not be replaced unless required by law.

24. Account Registration

You may be able to create an account on our website. You are responsible for keeping your login details confidential and for all activity that occurs under your account. You agree to provide accurate and up-to-date account information. We may suspend or close an account if we believe it has been misused or used in breach of these Terms & Conditions.

25. Privacy

We collect, use and handle personal information in accordance with our Privacy Policy. By using our website or placing an order, you agree that we may collect and use your personal information for purposes including processing orders, taking payment, arranging delivery, managing returns and warranty claims, customer support, fraud prevention, marketing where permitted, and improving our website and services.

26. Email and SMS Marketing

If you subscribe to our email or SMS marketing, we may send you promotional messages, product updates, offers and other marketing communications. You can unsubscribe at any time by using the unsubscribe link or instructions provided in the message. Transactional messages relating to orders, shipping, account activity or customer service may still be sent where necessary.

27. Website Content and Intellectual Property

All website content, including text, images, graphics, logos, product information, design, layout and other materials, is owned by us or licensed to us. You must not copy, reproduce, distribute, modify, publish or use any website content without our written permission, except as allowed by law. Third-party trademarks, product names and brand names remain the property of their respective owners.

28. Third-Party Links

Our website may contain links to third-party websites, payment providers, delivery providers, manufacturers or other external services. We are not responsible for the content, accuracy, policies, security or practices of third-party websites. Your use of third-party websites or services is at your own risk and may be subject to their own terms and conditions.

29. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, including loss of profit, loss of revenue, loss of opportunity, loss of data, vehicle downtime, or business interruption.

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies you may have under Australian Consumer Law or any other law that cannot be excluded. Where we are permitted by law to limit our liability, our liability is limited to one or more of the following:

  • replacement of the goods;
  • repair of the goods;
  • payment of the cost of replacing the goods;
  • payment of the cost of repairing the goods;
  • resupply of services;
  • payment of the cost of having services supplied again.

30. Force Majeure

We are not responsible for delays or failure to perform our obligations where caused by events outside our reasonable control. This may include supplier delays, carrier delays, natural disasters, extreme weather, strikes, transport disruptions, system outages, cyber incidents, government restrictions, pandemics, customs delays or other events beyond our control.

31. Errors and Website Availability

We aim to keep our website accurate and available, but we do not guarantee that the website will always be error-free, uninterrupted or up to date. We may correct errors, update information, change products, change prices, suspend the website or modify website functionality at any time.

32. Governing Law

These Terms & Conditions are governed by the laws of Australia and the state or territory in which our business is registered. You agree to submit to the jurisdiction of the courts of that state or territory.

33. Changes to These Terms

We may update these Terms & Conditions from time to time. The updated version will be published on this website and will apply from the date it is posted. Your continued use of our website after the Terms & Conditions are updated means you accept the updated terms.
